Terms of Service

By accessing or using the Polymorfa API service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

You are responsible for maintaining the confidentiality of your account credentials, including your API keys. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

You agree not to use the Service to:

• Send unsolicited messages (spam) or engage in any form of unauthorized messaging
• Transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Violate WhatsApp's Terms of Service or Business Policy
• Impersonate any person or entity or misrepresent your affiliation with any person or entity
• Engage in any activity that interferes with or disrupts the Service
• Attempt to gain unauthorized access to any portion of the Service
• Use the Service for any illegal purposes or in violation of any applicable laws

Your use of the API is subject to rate limits and usage quotas based on your subscription plan. Exceeding these limits may result in temporary suspension of your API access. We reserve the right to modify rate limits at any time with reasonable notice. Abuse of the API or attempts to circumvent rate limits may result in immediate termination of your account.

To the maximum extent permitted by law, Polymorfa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service. In no event shall our aggregate liability exceed the amount you paid us in the twelve (12) months preceding the claim.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us at hello@polymorfa.com.

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Polymorfa operates, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
